Residential Real Estate Commissions Settlements

If you sold a home and paid a commission to a real estate agent, then you may be part of a class action settlement.

 

These Settlements resolve claims against The National Association of REALTORS® (“NAR”) and HomeServices of America, Inc., BHH Affiliates, LLC, Long & Foster Companies, Inc., and HSF Affiliates, LLC (together, “HomeServices” and also known as “Berkshire Hathaway HomeServices”) in several lawsuits alleging the existence of an anticompetitive agreement that resulted in home sellers paying inflated commissions to real estate brokers or agents in violation of antitrust law. In addition to releasing the claims in these lawsuits, these Settlements release all Released Claims that any Settlement Class members have against NAR and the other released parties, as described in FAQ 14 and 15, and HomeServices, regardless of whether that Settlement Class Member has already brought suit and regardless of whether the Settlement Class Member also was a homebuyer during the Applicable Date Ranges.

The current value of all settlements with NAR and HomeServices and other Defendants is over $980 million. 

To be eligible to receive the benefits of the Settlements, you must have: (1) sold a home during the Eligible Date Range; (2) listed the home that was sold on a multiple listing service (“MLS”) anywhere in the United States; and (3) paid a commission to any real estate brokerage in connection with the sale of the home. The Eligible Date Range depends on which MLS you listed your home for sale on. The terms “multiple listing service” and “MLS” encompass multiple listing services nationwide, regardless of whether they are affiliated with NAR or not, including, for example, NWMLS, WPMLS, and REBNY/RLS. The Eligible Date Ranges can be found on the NAR Long Form Notice and HomeServices Long Form Notice and also in FAQs 7 and 8

If you have already submitted a claim form in this case for a prior settlement with other Defendants, you do not need to submit another claim form. You may be eligible for a share of multiple Settlements. With one claim form, you will receive your share of each Settlement that you are eligible for.

The Court in charge of this case still has to decide whether to approve the proposed Settlements. Payments will be made if the Court approves the Settlements and after appeals are resolved. Please be patient.

Along with the proposed Settlements with NAR and HomeServices, other proposed Settlements have been reached with Anywhere, RE/MAX, Keller Williams, Compass, Real Brokerage, Realty ONE, @properties, Douglas Elliman, Redfin, Engel & Völkers, HomeSmart, United Real Estate, and certain of their affiliates. Some of those Settlements have already received final approval from the District Court. You may not receive any additional written notice about future Settlements, so it is important that you continue to check this website to stay up to date.

YOUR LEGAL RIGHTS AND OPTIONS IN THE NAR AND HOMESERVICES SETTLEMENTS:
SUBMIT A CLAIM FORM BY MAY 9, 2025 The only way to get a payment. 
ASK TO BE EXCLUDED BY OCTOBER 28, 2024 If you do not want to be included in the Settlements with NAR and/or HomeServices, you must exclude yourself. This is called “opting out.” This is the only option that allows you to sue NAR and/or HomeServices for these same issues again. See FAQ 16, 17, and 18.
OBJECT BY OCTOBER 28, 2024 You may write to the Court about why you don’t like the proposed Settlements. You cannot object if you opt-out. See FAQ 21.
GO TO A HEARING ON NOVEMBER 26, 2024 You may ask to speak in Court about the fairness of the proposed Settlements with NAR and HomeServices. See FAQ 23, 24, and 25.
DO NOTHING If you do nothing and the Court approves the proposed Settlements, you will get no payment. You will not be able to sue NAR or HomeServices for these same issues again.
